1. Introduction and Acceptance of Terms
Welcome to the Nchemty MFI COOP With BOD (“Nchemty MFI,” “we,” “us,” or “our”) digital banking platform, which includes the website located at nchemty.com and the mobile banking application (collectively, the “Service”). The Service provides you with digital access to your accounts and financial services offered by Nchemty MFI.
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you, the user (“you,” “your,” or “User”), and Nchemty MFI. By accessing, using, or registering for the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
2. Services and Account Registration
2.1. Services Offered:
The Service allows you to perform various banking activities, including but not limited to:
- Viewing account balances and transaction history.
- Initiating fund transfers between your accounts.
- Initiating fund transfers to other Nchemty MFI members.
- Accessing information about our products and services.
2.2. Eligibility:
To use the Service, you must be a registered member of Nchemty MFI COOP With BOD and have at least one active account. You must also be of legal age as per the laws of Cameroon to enter into a contract.
2.3. Account Registration:
To access the Service, you must complete the registration process and create an online account. You agree to provide accurate, current, and complete information and to keep this information updated. You are responsible for all activities that occur under your account.
3. Security and User Responsibilities
3.1. User Security:
You are solely responsible for maintaining the confidentiality of your account credentials, including your username, password, and any PINs or biometric data used to access the Service. You agree to notify Nchemty MFI immediately of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to comply with this section.
3.2. Device Security:
You are responsible for the security of your device used to access the Service. This includes using up-to-date antivirus software, keeping your operating system and app updated, and protecting your device from unauthorized access. Nchemty MFI is not responsible for any losses resulting from the compromise of your device.
4. Transactions and Fees
4.1. Transaction Authorization:
All transactions initiated through the Service must be authorized by you using your secure credentials. Once a transaction is submitted, it may not be reversible.
4.2. Fees and Charges:
You agree to pay all fees and charges associated with your use of the Service, as outlined in our fee schedule. Nchemty MFI reserves the right to change its fees and will provide notice of any changes in accordance with these Terms and applicable laws.
5. Intellectual Property
All content, logos, trademarks, and intellectual property on the Service (nchemty.com and the app) are the exclusive property of Nchemty MFI or its licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
6. Limitation of Liability
To the fullest extent permitted by Cameroon law, Nchemty MFI shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the Service, or from any unauthorized access to or alteration of your transmissions or data.
7. Governing Law and Dispute Resolution
7.1. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of the Republic of Cameroon.
7.2. Dispute Resolution:
In the event of any dispute or claim arising out of or in connection with these Terms, both parties agree to first attempt to resolve the matter amicably through negotiation. If the dispute cannot be resolved, it shall be submitted to the competent courts in the Republic of Cameroon for resolution.
8. Termination of Service
Nchemty MFI reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may also terminate your use of the Service at any time by notifying Nchemty MFI. Upon termination, your account access will be deactivated, but you will remain responsible for any outstanding fees or obligations.
9. Amendments to Terms
Nchemty MFI reserves the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on our website and app. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
