Terms and conditions

Nchemty Credit Union Cooperative · Bokwango, Buea, South West Region, Cameroon · COBAC approval [APPROVAL NO.] · infos@nchemty.com · +237 679 923 521

These terms govern your use of Nchemty Digital Banking. Please read them before you register. By enrolling or using the services you accept them. They complete the account agreement and the product conditions of your accounts; if they conflict, the account agreement and product conditions prevail.

1. Parties

These terms are between Nchemty Credit Union Cooperative (“Nchemty”, “we”), a microfinance institution approved by COBAC, and the member or customer who uses the services (“you”). Where an account belongs to an association, njangi group or company, “you” also means each person authorised to use the services for it, and the organisation is bound by their use.

3. Who can use the services

You must hold an account with Nchemty, or be applying for one, and have legal capacity. Accounts for minors are operated by a parent or legal guardian. You must use the services only for yourself or the organisation that authorised you, and only for lawful purposes.

4. Opening an account online

Submitting an application through the services does not open an account. We verify your identity and the information you give, as the law requires, using document checks, a live selfie and comparison with your identity document. We may ask for more information or documents, delay or refuse an application, and open an account only after approval by our staff. You confirm that the information and documents you provide are true, complete and your own, and you must tell us promptly when they change.

5. Enrolment and access

When your account is approved we give you a login name for e-banking and ask you to set your own passwords. Access to e-banking from the client area requires your separate e-banking password and one-time codes sent to your registered phone and e-mail, and new devices must be confirmed. We may change our security procedures to protect you; we will tell you how.

6. Your credentials and devices

You must:

  1. keep your credentials secret and never disclose them to anyone, including people claiming to be Nchemty staff: we will never ask for your password, PIN or one-time codes;
  2. choose passwords that others cannot guess, and change them if you think someone knows them;
  3. keep your phone and devices protected by a screen lock, use only the official app and website, and keep them up to date;
  4. not let anyone else use your credentials or your registered devices;
  5. tell us immediately at +237 679 923 521 or infos@nchemty.com, or through the client area, if your credentials or phone are lost, stolen or may be known to someone else, or if you see a transaction you did not make. We will then block access to protect your accounts.

7. Instructions and authentication

An instruction given with your credentials is treated as given by you and authorises us to carry it out, unless you had already told us that your credentials were lost, stolen or misused. Check each instruction before you confirm it: once confirmed, an instruction generally cannot be cancelled. We may refuse or delay an instruction that exceeds a limit, lacks funds, appears unlawful, fraudulent or inconsistent with your usual activity, or that we must refuse by law, and we will tell you unless the law forbids it. Instructions received after our cut-off time or on a non-business day may be processed on the next business day.

8. The services

Depending on your account and the channel, the services let you view balances and statements, transfer funds between your accounts and to other Nchemty members, pay and receive payments, top up your account from mobile money and cash out to mobile money, follow applications and requests, and contact us. We may add, change or withdraw features; we will give notice when a change reduces what you can do.

9. Mobile-money top-up and cash-out

  1. You may link only a mobile-money number registered in your own name (or, for an organisation, a number it has authorised).
  2. A top-up credits your Nchemty account once the operator confirms the payment. A cash-out debits your Nchemty account and sends the amount, minus applicable fees, to your mobile-money wallet.
  3. You must confirm each operation, including any approval the operator asks for on your phone.
  4. Operations depend on the operator's systems. If the operator does not confirm an operation, we do not complete it and we reverse any amount debited, normally within [2] business days.
  5. Fees and limits per operation, per day and per month are set out in the tariff and shown before you confirm. Operator fees and applicable taxes may apply.
  6. The operator's own terms govern your mobile-money wallet; Nchemty is not responsible for the operator's services.

10. Fees, charges and limits

We charge the fees in the tariff, which you can see on our website, in the app and at our offices. We debit fees from your account when the service is provided. We may set or change transaction limits for security and regulatory reasons. We will give you at least [30] days' notice of a fee increase, except where a change is required by law or is in your favour.

11. Statements and records

Your transactions appear in e-banking and the app, and you can download statements. Our records of instructions and transactions are evidence of them unless you prove otherwise. Check your transactions regularly.

12. Errors and unauthorised transactions

  1. Tell us without delay, and at the latest within [30] days of the date on the statement, if you notice a transaction you did not authorise or that was executed incorrectly.
  2. We will investigate, keep you informed, and give a reasoned answer.
  3. If a transaction was not authorised by you and you had protected your credentials as these terms require, we will refund it.
  4. You bear losses from unauthorised transactions made before you notified us if you acted fraudulently or failed, intentionally or through gross negligence, to protect your credentials or devices.
  5. After you notify us of a loss, theft or misuse, you do not bear losses from later unauthorised transactions, unless you acted fraudulently.
  6. If you send money to the wrong account or number because of details you entered, we will help you try to recover it but cannot guarantee recovery.

13. Availability

We aim to keep the services available at all times but do not guarantee uninterrupted access. They may be unavailable for maintenance, upgrades, security, failures of networks, mobile-money operators or electricity, or events beyond our control. We announce planned maintenance where we can. Interruptions do not affect the balances recorded in our systems; you can still use our offices and agents.

14. Security of the services

We protect the services with encryption, multi-factor authentication, device confirmation, monitoring and the other measures described in our Privacy policy. We may suspend access or block an instruction if we suspect fraud or a security risk, and we will contact you through your registered phone or e-mail.

15. Your other obligations

You must not use the services to break the law, to launder money or finance terrorism, to defraud anyone, to access data or accounts that are not yours, to send harmful code, to copy or reverse-engineer the app, or to disrupt our systems. You must keep your contact details current so that we can send you codes and notices. Information you see in the services is for your own use.

16. Suspension and blocking

We may suspend or restrict your access, block an instruction or freeze an account, with immediate effect where needed, if: your credentials may be compromised; we suspect fraud, unlawful activity or a breach of these terms; the law, a court or an authority requires it; your due-diligence information is incomplete or out of date; or to protect the security of the services. We will tell you and explain why, unless the law forbids it, and restore access once the reason ends.

17. Our liability

We are responsible for executing your instructions correctly and on time under these terms, the account agreement and the law, and for the losses this causes if we fail. We are not responsible for losses caused by: your failure to protect your credentials or devices; incorrect details you entered; the services of mobile-money operators, telecommunication networks or internet providers; your device or software; or events beyond our reasonable control. Nothing in these terms limits our liability where the law does not allow it to be limited, including for fraud or gross negligence on our part.

18. Personal data and confidentiality

We process your personal data as described in our Privacy policy and keep your information confidential as set out in our Confidentiality agreement. Both form part of these terms.

19. Communications

We communicate with you in English or French, as you choose, through the services, by e-mail, SMS or post to the details you gave us. Notices sent to those details are treated as received. Security codes are sent only to your registered phone and e-mail. We will never ask you to disclose your credentials by phone, e-mail, SMS or chat.

20. Complaints

You can complain through the client area, by e-mail to infos@nchemty.com, by phone on +237 679 923 521 or at any of our offices. We acknowledge every complaint, give you a reference, and answer within [15] working days, or tell you why we need longer. If you are not satisfied with our answer, you may refer the matter to the competent supervisory authority or the courts.

21. Ending the services

You may stop using the services or ask us to close your accounts at any time through www.nchemty.com/account-closure, the client area or our offices; balances must be settled first. We may end your access to the services with [30] days' notice, or immediately in the cases in section 16. Closing your digital access does not close your accounts unless you ask for that too. Obligations arising before the end, and our duty to keep records, continue.

22. Changes to these terms

We may change these terms to reflect new services, legal or regulatory requirements, or security needs. We will inform you at least [30] days before a change that is not in your favour takes effect, by e-mail or in the app. If you do not accept it, you may stop using the services and close your accounts without charge before the change applies; continuing to use the services means you accept it.

23. Intellectual property

The app, the website, their content and our trademarks belong to Nchemty or its licensors. We grant you a personal, non-transferable licence to use the app and the services for their intended purpose while you are our customer.

24. Law and disputes

These terms are governed by the law of Cameroon and the applicable CEMAC and COBAC regulations. We will try to settle any dispute amicably first. Failing that, the competent courts of [Buea, South West Region] have jurisdiction, without prejudice to your right to refer a matter to the supervisory authorities.

If any provision of these terms is found invalid, the others remain in force. These terms are available in English and French; both versions have equal value.
